Employment Practices Liability Insurance (EPLI)

from PLC Insurance

What is Employment Practices Liability Insurance (EPLI)?

EPLI protects businesses against allegations by employees that their legal rights under federal and state anti-discrimination or harassment laws have been violated.

The number of employment-related claims has been steadily on the rise, as is the potential financial risk to your business. In the face of this increased risk, it is also more likely that your current insurance excludes coverage for employment-related claims.

No company is immune to Employment Practice lawsuits, and defending a wrongful termination, sexual harassment or discrimination claim is very expensive, whether you’re guilty or innocent, and even if the claim is found to be fraudulent. All it takes is an allegation of a wrongful act and the company could end up spending thousands of dollars in legal expense to dismiss the allegation.

EPLI policies pay the legal costs to defend your company and any judgments or settlements. Employment Practices Liability Insurance will generally protect you from lawsuits alleging:

  • Sexual harassment
  • Discrimination
  • Disabilities
  • Wrongful termination
  • Breach of employment contract
  • Negligent evaluation
  • Negligent supervision
  • Negligent retention
  • Failure to employ or promote
  • Wrongful discipline
  • Deprivation of career opportunity
  • Wrongful infliction of emotional distress
  • Mismanagement of employee benefit plans
  • Statute Violation
  • Loss of Consortium
  • Invasion of Privacy
  • Wage and Hour Disputes
  • Drug Testing
  • Mental Anguish
  • Libel
  • Slander

The costs of battling a lawsuit in court are staggering, whether you win or lose. Rather than face these unexpected costs, EPLI protection can be purchased to protect your business and your assets. The cost of EPLI coverage depends on your type of business, number of employees, and various risk factors, such as whether your company has been sued over Employment Practices in the past.

Along with an EPLI policy, prevention is the best method to avoid a lawsuit, so be sure to train your managers and employees to minimize problems in the first place:

  • Create effective hiring and screening programs to avoid discrimination.
  • Develop and distribute an employee handbook to all employees which includes the company’s anti-discrimination and sexual harassment policies
  • Post corporate policies throughout the workplace
  • Show employees what steps to take if they are the object of sexual harassment or discrimination by a supervisor and that no retaliation will be permitting for coming forward. Make sure supervisors know where the company stands on what behaviors are not permissible.
  • Document everything that occurs, and the steps your company is taking to prevent and solve employee disputes.
